Italian Administrative Justice runs towards modernity

As of January 1, 2017, any new petition before the Administrative Courts shall be filed through electronic means as stated by Law Decree no. 168/2016. During a transitional period, which will end on December 31, 2017, the parties shall also submit a paper-copy of their briefs. The proceedings started before January 1, 2017, will remain on the traditional “paper path”.

In addition, Decree no. 167/2016 issued by the President of Consiglio di Stato on December 29, 2016 sets important rules to ensure that the briefs of the parties be clear and concise (see, http://maurizioreale.it/wp-content/uploads/2016/12/Decreto-sinteticit%C3%A0-atti.pdf).

Making the proceedings before Italian administrative courts more predictable and efficient is a necessary accomplishment to increase foreign investors’ trust in Italian market.
